1. Acceptance of Terms

By accessing and using the Vadapav Mirchi mobile application and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all users, including customers, restaurant partners, and delivery personnel. By using our services, you confirm that you are at least 18 years of age or have parental/guardian consent.

2. Service Description

Vadapav Mirchi provides an online platform connecting customers with pure vegetarian restaurants and food vendors. Our services include:

  • Browse and order food from partner restaurants
  • Real-time order tracking and delivery updates
  • Secure payment processing
  • Customer support and order management
  • Loyalty rewards and promotional offers

We act as an intermediary between customers and restaurants. While we facilitate orders, the restaurants are responsible for food preparation and quality.

3. Orders and Payments

Order Placement:

  • All orders are subject to availability and acceptance by the restaurant
  • Prices displayed include applicable taxes (GST/PST/HST) as required by law
  • Delivery fees and service charges are clearly indicated before checkout
  • Minimum order values may apply for certain restaurants

Payment Terms:

  • We accept credit/debit cards, Interac, and digital wallets
  • Payment is processed at the time of order placement
  • All transactions are secured with industry-standard encryption and comply with Canadian payment processing standards
  • You are responsible for maintaining the confidentiality of your payment information

4. Cancellations and Refunds

Cancellation Policy:

  • Orders can be cancelled within 60 seconds of placement for a full refund
  • After 60 seconds, cancellations are subject to restaurant approval
  • Once food preparation begins, orders cannot be cancelled
  • Cancellation fees may apply based on order status

Refund Policy:

  • Refunds are processed within 5-10 business days in accordance with Canadian consumer protection laws
  • Refunds for quality issues require photo evidence and must be reported within 24 hours of delivery
  • Partial refunds may be issued for missing items
  • Refunds are credited to the original payment method
  • You have the right to dispute charges in accordance with your payment provider's policies

5. User Responsibilities

As a Vadapav Mirchi user, you agree to:

  • Provide accurate delivery information and contact details
  • Be available to receive orders at the specified delivery address
  • Not misuse the platform for fraudulent activities
  • Treat delivery personnel and customer support staff with respect
  • Not share your account credentials with others
  • Report any issues or discrepancies promptly
  • Comply with all applicable laws and regulations

6. Limitation of Liability

Vadapav Mirchi acts as a platform connecting customers with restaurants. Subject to applicable consumer protection laws in British Columbia and Canada, we are not responsible for:

  • Food quality, taste, or preparation standards (restaurants are responsible for food safety and quality)
  • Allergic reactions or food-related health issues (please inform restaurants of dietary restrictions)
  • Delays caused by weather, traffic, or unforeseen circumstances beyond our reasonable control
  • Restaurant closures or menu unavailability
  • Third-party payment gateway failures

To the extent permitted by law, our total liability for any claim arising from our services shall not exceed the amount paid for the specific order in question. Nothing in these terms excludes or limits our liability for fraud, gross negligence, or matters that cannot be excluded under Canadian consumer protection legislation.

7. Intellectual Property

All content on the Vadapav Mirchi platform, including logos, trademarks, text, images, and software, is the property of Vadapav Mirchi or its licensors and is protected under Canadian intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission. You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only.

8. Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activities, or misuse our platform. We will provide reasonable notice before termination unless immediate action is required for security or legal reasons. You may also request account deletion at any time through our Account Deletion page. Upon termination, you remain responsible for any outstanding payments.

9. Privacy and Data Protection

We are committed to protecting your personal information in accordance with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA). Please review our Privacy Policy for details on how we collect, use, and protect your data.

10. Modifications to Terms

We may update these Terms and Conditions from time to time. Significant changes will be communicated via email or in-app notifications at least 30 days before they take effect. Continued use of our services after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you may terminate your account.

11. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Dispute Resolution:

  • We encourage you to contact us first to resolve any disputes informally
  • If informal resolution is unsuccessful, disputes may be resolved through mediation or arbitration
  • Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of British Columbia
  • Nothing in these terms affects your rights under Canadian consumer protection legislation
